Anyone who is younger than 16 years old may not obtain a marriage license. Per Idaho Code, a marriage may not take place when one of the applicants is under the age of 18 and the applicants are more than three years apart in age.

To be married, you must obtain a marriage license from the County Recorder before the wedding ceremony. To obtain a marriage license, both applicants must appear together before the deputy clerk. Any unmarried male of the age of eighteen (18) years or older, and any unmarried female of the age of eighteen (18) years or older, and not otherwise disqualified, are capable of consenting to and consummating marriage. Where the female is under the age of sixteen (16), or the male is under the age of sixteen (16), the license shall not be issued.
